  • INTRODUCTION
    • This Privacy Statement ("statement") is given by Resort Corp Pty Ltd A.C.N. 087 479 975 and any of its related or associated entities ("Resort Corp").
    • This statement relates to The Beach Shacks development undertaken by Resort Corp, located at Casuarina Beach, NSW ("development").
    • Resort Corp is subject to the National Privacy Principals under the Privacy Act 1988 (Cth) ("Act").
    • This statement will apply to any personal information about you (as defined in the Act) which you or a third party provide to Resort Corp when dealing with Resort Corp.
    • This statement has been prepared in compliance with National Privacy Principle 1.3 and explains in general terms how Resort Corp protects the privacy of your personal information.
  • RESORT CORP CONTACT DETAILS AND ACCESS TO INFORMATION
    • You are able to gain access to personal information about you collected by Resort Corp by contacting Resort Corp as specified below: (a) By Post: PO Box 7917 GCMC QLD 9726 (b) By Telephone: 5570 0900 (c) By Email: via the Resort Corp website at www.resortcorp.com.au or the website for the development at www.thebeachcabarita.com.au ("sites").
    • Resort Corp will provide you with access to the personal information it holds about you unless there is an exception which applies under the National Privacy Principles.
    • Resort Corp may recover from you its reasonable costs of supplying you with access to this information.
    • Your request to provide access to this information will be dealt with within a reasonable time.
    • If Resort Corp refuses to provide you with access to personal information about you, Resort Corp will provide you with reasons for the refusal and inform you of any exceptions relied upon under the National Privacy Principles.
  • PURPOSE OF COLLECTION
    • Resort Corp is a leading property development organisation, which specialises in boutique beachfront residences and resorts.
    • Resort Corp will collect a range of personal information about you in relation to the development for the purpose of enabling Resort Corp to: (a) discuss with you any matters relating to the development; (b) negotiate with you for the sale of any property and the provision of any related services in relation to the development; and (c) enter into any contractual documentation with you pursuant to this (for instance, any sale contracts and letting agreements in relation to the development).
    • Resort Corp may also collect personal information about you to: (a) provide you with advertising material relating to the development or any other property development of Resort Corp; and/or (b) compile statistics to be used by Resort Corp.
    • However, Resort Corp will give you the opportunity to decline to receive this further advertising material.
    • Resort Corp may also be required to collect personal information about you in order to comply with relevant laws.
  • TYPE OF PERSONAL INFORMATION COLLECTED
    • The personal information which Resort Corp would usually collect about you in relation to the development will include: (a) your name; (b) your contact details; (c) information relating to your preferences, lifestyle, background, family structure and property ownership; and (d) information relating to your negotiations with Resort Corp in relation to the development.
    • Resort Corp reserves the right to collect other types of personal information about you for the purposes stated in paragraphs 3.2, 3.3 and 3.5. 4.3 Where personal information about you is "sensitive information" within the meaning of the Act, Resort Corp may only collect that information where it is permitted to do so under the Act.
  • MANNER OF COLLECTION
    • Resort Corp may collect personal information about you in a variety of ways.
    • For example, Resort Corp may collect personal information about you: (a) in person (either when you deal directly with Resort Corp or with any of its authorised representatives); (b) by telephone; (c) in writing; (d) through the sites; or (e) by other electronic communication channels when you liaise with Resort Corp in any way in relation to the development.
    • Resort Corp reserves the right to collect personal information about you in any other way that Resort Corp may lawfully do so.
  • COLLECTION FROM THIRD PARTIES
    • As well as collecting information directly from you, there may be occasions when Resort Corp collects personal information about you from others.
    • The type of personal information about you collected from other people or organisations will usually be the same information referred to in clause 4.1.
    • However, wherever reasonable and practicable, Resort Corp will only collect personal information about you from you.
    • If you disclose personal information to Resort Corp about another person, then you promise Resort Corp that: (a) you will at all times comply with the Act in relation to the personal information of another person; (b) the other person has consented to Resort Corp collecting, using and disclosing that personal information as contemplated in this statement; (c) the other person agrees to be bound by this statement; and (d) Resort Corp will not be responsible or liable in any way for any harm of loss to the other person if you do not comply with any of the above promises.
  • COOKIES
    • When you visit the sites, details may be recorded about your visit, such as: (a) the time and date of the visit; (b) your server address; (c) the type of browser you used; (d) the pages accessed; and (e) the time spent during the visit.
    • This information is used in an anonymous form for statistical purposes and as such cannot identify you individually.
    • Resort Corp may use cookies to identify your browser so that next time you visit the sites, Resort Corp can remember your log-in details.
    • A cookie is a small file which remains on your computer and contains information enabling the sites to recognise your browser.
    • If you do not wish to use cookies, you can adjust the settings on your browser to reject cookies or notify you when they are being used.
  • DISCLOSURE OF INFORMATION
    • Subject to paragraph 8.2, Resort Corp may disclose personal information about you to any or all of the following entities: (a) any member of Resort Corp; (b) any relevant departments, authorities or agencies; and/or (c) any advisors, consultants, agents, contractors, employees or other persons authorised by or under the control of any of the above entities.
    • Resort Corp will only disclose personal information about you to the entities specified in paragraph 8.1 if disclosure to those entities is necessary for the purposes stated in paragraphs 3.2, 3.3 and 3.5.
    • Resort Corp will not release your personal information to direct marketers.
    • Resort Corp will not send any personal information about you overseas unless: (a) you consent to this; (b) Resort Corp reasonably believes that the other country has privacy laws substantially similar to those of Australia; or (c) Resort Corp provides the information in other circumstances giving like protection.
  • MAINTAINING YOUR PERSONAL INFORMATION
    • Resort Corp will take reasonable steps to ensure that your personal information is accurate, complete and current.
    • You may contact Resort Corp to request that personal information about you be corrected to ensure that it is accurate, complete and current.
  • SECURITY AND ANONYMITY
    • Resort Corp will use reasonable endeavours to ensure that your personal information is secure against unauthorised access.
    • For example: (a) Resort Corp’s electronic database can only be accessed by Resort Corp employees, and is password-protected to prevent unauthorised access; (b) Resort Corp’s staff are trained and required to protect the privacy of your personal information; and (c) Resort Corp’s contracted agents and service providers have been informed of the importance of protecting your privacy.
    • If you request to do so, you may deal with Resort Corp anonymously provided that it is lawful and practicable to do so.
  • PRIVACY POLICY
    • Resort Corp has a privacy policy which deals with management of your personal information.
    • You can access this privacy policy by contacting Resort Corp as specified above.
  • FURTHER CONCERNS
    • If you wish to gain access to your personal information, have a complaint about a breach of your privacy or you have any query on how your personal information is collected or used, please contact Resort Corp as specified above.
    • If you believe there are errors in the records of your personal information which Resort Corp holds about you, please contact Resort Corp as specified above and Resort Corp will investigate and seek to correct any inaccuracies.
  • YOUR CONSENT
    • Without collecting, using and disclosing the above personal information about you, Resort Corp may not be able to engage in any of the activities referred to in clause 3.2.
    • Therefore, unless you advise Resort Corp otherwise, you: (a) consent to Resort Corp collecting, using and disclosing personal information about you as specified above; and (b) agree to be bound by this statement.
  • CHANGES TO THIS STATEMENT
    • Resort Corp may make changes to this statement without notice.
